The detained Mr. V. Yakovchenko explained that on December 28th, 2009 I. Usanov, his head at OOO “Alfa-Inform”, assigned him a task to verify the address of the PR agency located at Khoroshevskoye shosse, 68, bld. 1, where correspondent John Helmer lives. Receiving the information report on the internet data for Mr. Helmer and his office, around 11:30 together with the firm’s driver he left for that address, where he arrived around 12:30. Finding no office buildings, Yakovchenko came to the entrance of the address indicated in the report and several times called at apartment 32, where, according to the given information, the office was located. Receiving no answer, he returned to the car and called his head Usanov telling him he failed to find the office. He was given a command to wait at the place. Then he called another acquaintance of his, with whom he had previously agreed on purchase of a camera, and asked him to arrive at Khoroshevskoye Shosse, 66. Yakovchenko and Sharendo (the driver of the car) decided to have a snack while waiting for their head. Yakovchenko got out of the car and met with Mr. Khoroshev in the street. At that moment police members arrived and asked them to proceed to the OVD of the Khoroshevsky raion, where later Mr. Usanov arrived. Similar explanations, confirming this, were given by the detained Mr. Sharendo and Khoroshev. An explanation was also given by Mr. I.G. Usanov, who explained that on December 28th, 2009 he had given his subordinate Yakovchenko a task to verify the location of the office for a further meeting with Mr. Helmer. Around 13:00 Yakovchenko called and reported that he had failed to find the office. Then Usanov told him to wait for him at the place. Then Yakovcheno called him again and informed him that he is at the OVD of the Khoroshevsky raion of Moscow, where Ushanov arrived later.

Also the police examined the Chevrolet car, registration number Y 115 AM 190, and found six A4-sized pages with printed text and photos.

Taking into account the facts explained above, and also basing on stipulation of Article 24 item 1, Art. 144, and Art. 148 of the Criminal Procedure Code of the Russian Federation,

WE HOLD THAT:

1. Criminal case be denied basing on Art. 24 item 1, Art. 144 and Art. 148 of the Criminal Procedure Code of the Russian Federation, in connection with absence of a criminal act.

2. A copy of the present ruling be sent to prosecutor of the Savyolovskaya Mezhrayonaya prokuratura [inter-regional prosecutor’s office].

3. A copy of the present ruling be sent to Mr. J. Helmer, explaining to him his right to file an appeal against the present ruling to the prosecutor or to the court in order provided by Art. 124 or Art. 125 of the Criminal Procedure Code of the Russian Federation.

DECREE
on denial of criminal case
Moscow, January 05 2010

I, A.N. Yudenkov, senior authorized operations officer of the Criminal Law Branch of the OVD of the Khoroshevsky raion of Moscow, police senior lieutenant, checking the material of the primary examination of KUSP number 10916 of December 28th, 2009, on the fact of Mr. Helmer’s claim that on December 28th, 2009 someone called at his door intercom and that unknown people were at the entrance of his place of residence, Moscow, Khoroshevskoye shosse, 68, bld. 1.

FOUND THAT:

On December 28th, 2009 Mr. Helmer turned to the police control room of the OVD of the Khoroshevsky raion of Moscow upon the fact that on December 28th, 2009 around 12:30 unknown people called via the door intercom at the address of his place of residence, Moscow, Khoroshevskoye shosse, 68, bld. 1, apartment 32, but he did not answer the call, and instead he came to the apartment’s window and at the entrance he saw a car with 3 or 4 persons in it. He reckoned that those persons endangered his security. After that he called his wife and asked her to call “02” and make a corresponding claim. After the call at OVD, a police detachment arrived at the place and took the given car, together with the persons inside, to the police control room of the OVD of the Khoroshevsky raion of Moscow.

An explanation was also received from Mr. Helmer, in which he stated that on December 28th, 2009 around 12:30 he was home, at the address Moscow, Khoroshevskoye shosse, 68, bld. 1, apartment 32, and at that time he received a call via the door intercom. He left the call unanswered and came to the window, which gives a good view of the porch entrance. Someone was calling at the door intercom for 5-10 minutes. Then the man whom Mr. Helmer had not seen before, went back from the entrance to sit into a car, parked in front of the entrance. The driver got out of the given car, opened the hood of the car, and started to perform operations connected with repairs. The car was a Chevrolet, registration number Y 115 AM 150 or 190. Mr. Helmer took photos of the given car. After that he called his wife and asked her to call the police which she did. The situation seemed suspicious to Mr. Helmer, because 2 or 3 weeks before he had received a call from the Foreign Office of Australia and he was informed that they have information that Mr. Helmer is in danger in Moscow, and also a week before a strange man called at his door, who identified himself as an FSB member, but did not disclose the purpose of his visit.

As a result of the check that followed, the car that had been parked at the entrance of the address of Mr. Helmer’s place of residence was identified. The given car, a Chevrolet, registration number Y 115 AM 190, was spotted at the neighbouring house number 66, Khoroshevskoye shosse, in front of the second entrance, with the three men, who gave their explanations.
